These Terms of Service ("Terms") govern your use of the website at opsmasterysolutions.com and any consulting services provided by OPS Mastery Solutions ("we," "our," or "us"). By using this site or engaging us for services, you agree to these Terms.
OPS Mastery Solutions provides consulting services to creators, coaches, and audience-driven businesses. Our primary offering is the Offer Launch Method, a done-with-you engagement that helps a client design and build a monetization system around their existing audience. Specific scope, deliverables, timeline, and fees for each engagement are set out in a separate written agreement with the client.
To engage our services you must be at least 18 years old and able to enter into a binding contract. You represent that any information you provide is accurate and that you have the authority to enter into this agreement on behalf of yourself or the entity you represent.
Fees for each engagement are quoted during the discovery process and confirmed in a written agreement before work begins. Unless stated otherwise, fees are billed in U.S. dollars and are non-refundable once an engagement has started, except where the written agreement says otherwise. Late payments may be subject to reasonable interest and suspension of service.
Our engagements are done-with-you. That means the client's active participation is required for the engagement to succeed. You agree to attend scheduled working sessions, respond to async questions in a reasonable timeframe, and provide the access and information needed to complete the work. If a client materially fails to participate, we may pause or terminate the engagement.
The systems, templates, scripts, and methodology used during an engagement are the intellectual property of OPS Mastery Solutions. On completion of an engagement we grant the client a perpetual, non-exclusive, non-transferable license to use the specific deliverables produced for them in the operation of their own business.
The client retains ownership of any content, brand assets, audience data, or proprietary information they provide to us. We will not use client materials for any purpose other than fulfilling the engagement, without written permission.
Some of our work involves accessing publicly available information from third-party platforms (for example, Meta's Instagram Graph API). We do this in compliance with those platforms' terms. We do not guarantee the continued availability, accuracy, or behavior of third-party platforms, and we are not responsible for changes made by those platforms that affect an engagement.
Each party agrees to keep the other's non-public information confidential and to use it only for purposes related to the engagement. This obligation survives termination of the engagement.
Our services are provided on an "as is" basis. We make no guarantees about specific financial outcomes, revenue, audience growth, or business results. Any examples or illustrations are for information only and are not promises of performance. You are responsible for your own business decisions.
The website may contain links to third-party sites. We are not responsible for the content, policies, or practices of those sites.
To the maximum extent permitted by law, in no event will OPS Mastery Solutions be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data. Our total aggregate liability for any claim arising out of or relating to the engagement will not exceed the fees paid by the client for the engagement in question.
Either party may terminate an engagement for material breach if the breach is not cured within a reasonable period after written notice. Upon termination, the client will pay for work completed up to the date of termination. Sections that by their nature should survive termination (confidentiality, intellectual property, limitation of liability) will survive.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles. The state and federal courts located in Davidson County, Tennessee will have exclusive jurisdiction over any dispute arising out of or related to these Terms or our services.
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continued use of the site or services after a change constitutes acceptance of the updated Terms.
